Terms of Service

The Canister Company provides Website-as-a-Service (WaaS) and Software-as-a-Service (SaaS) solutions through a subscription model. Each subscription tier — Starter, Professional, Business, and Enterprise — includes a fully managed, custom-built website or web application hosted on our infrastructure.

All plans include hosting, SSL/security, maintenance, and a defined number of monthly revision requests as specified at the time of subscription. The specific features included in each tier are outlined on our pricing page and in your signed quote.

Subscriptions are billed monthly in advance. A one-time setup fee applies at the start of the engagement as specified in your quote. Subscriptions auto-renew each month unless cancelled with the required notice period.

If payment is not received within 14 days of the due date, service may be suspended until the outstanding balance is settled. We will notify you before any suspension is applied.

Each subscription tier includes a defined number of revision requests per month — these are updates, content changes, or minor feature additions submitted through our client portal or contact channel. Revisions are completed within 5 business days of submission.

Unused revisions do not roll over to the following month. Additional revision requests beyond your plan's monthly allowance may be purchased as an add-on. Major new features or significant scope changes are treated as new development and quoted separately.

You may cancel your subscription at any time with 30 days written notice. Upon cancellation, you will continue to receive service until the end of the notice period. After the notice period, your site will be archived and a migration package made available for 30 days.

Setup fees are non-refundable once the build process has commenced. Monthly subscription fees are prorated for partial months where applicable. No refunds are issued for unused revision requests within a billing period.

We reserve the right to suspend or terminate service in the following circumstances: non-payment after a 14-day grace period; material breach of these terms not remedied within 7 days of notice; use of the service to host illegal, harmful, or defamatory content; or any action that damages our infrastructure or other clients.

Where possible, we will provide written notice and an opportunity to remedy the breach before suspension or termination is applied.

Client-provided content, brand assets, logos, images, and copy remain the intellectual property of the client at all times. The Canister Company retains all rights to the underlying platform, codebase, infrastructure, frameworks, and proprietary tools used to deliver the service.

Upon cancellation and during the migration window, clients may export their content and assets. The custom build delivered to a client under an active subscription may not be copied, resold, or redistributed without prior written consent.

The Canister Company shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of business revenue, loss of data, or reputational harm arising from the use of our services.

Our maximum total liability for any claim arising under these terms shall not exceed the total fees paid by the client in the three months immediately preceding the claim.

These terms are governed by the laws applicable to the registered business jurisdiction of The Canister Company. Any disputes arising from these terms shall be resolved in the courts of that jurisdiction, unless otherwise agreed in writing.
